  1. Brum Tours Contract With You
    • These are the terms and conditions on which we supply the services to you.
    • Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.
    • Bookings for a tour can made online through the website or over the phone during office hours Monday to Friday, from 10am to 4:30pm. For groups of 25 people or more, bookings must be made by phone. Full payments must be made at the time of booking
    • Our acceptance of your booking will take place when we email you with the order confirmation to accept it, at which point a contract will come into existence between you and us.
    • Brum Tours will assign an order number to your order which you will be notified of in the order confirmation. It will help us if you can tell us the order number whenever you contact us about your order.
    • Unfortunately, we do not accept orders for goods from addresses outside the UK.
  1. Providing Services
    • Booking confirmation shall only be delivered by email.
    • We will provide the tour on the date selected and confirmed during the order process. All tours start at 7pm and finish by 10:30pm. Although every effort is made to ensure that tours end by 10:30pm, given the nature of the question and answer session at the end of each tour, it is possible that tours may finish after 10:30pm. Attendees are free to leave a tour early so long as the Brum Tours Limited representative is informed.
    • Brum Tours will not be liable for delays caused by an event outside our control.
    • If fewer than 25 people are booked onto a tour, you will be notified at least 2 days in advance ahead of the tour start time that the tour may be rescheduled. If, because of unexpected limits on our resources which we could not reasonably plan for, the tour cannot go ahead, as much notice as possible will be given informing that the tour will be rescheduled.
    • We may need certain information from you as part of the tour, for example, dietary requirements. If you do not give us this information at the point of booking, or if you give us incomplete or incorrect information, we will not be responsible for not accommodating dietary requirements if this is caused by you not giving us the information at the point of booking.
    • If the kitchen is able to accommodate dietary requirements on the day of the tour, which Brum Tours had not previously been notified of, an additional cost of up to £10 will be incurred to accommodate such requirements and will be charged to the customer at the tour.
    • Please notify at the point of booking if any people being booked onto the tour are wheel chair users. This will not affect the tour route but will simply enable Brum Tours to reserve an area within the pub for the comfort of the wheelchair user.
    • In the event of severe weather conditions, tours may be postponed and every effort will be made to contact and notify you in advance of the postponement. If a customer is unable to attend due to the weather, the option to rebook will not be available and the amount paid will not be refunded.
    • Brum Tours Limited will not be held liable for any costs incurred by a customer (for example pre booked travel expenses or accommodation) in the event of a cancellation, postponement or non-attendance.
  2. Price and Payment
    • The price of the tours (which includes VAT) will be the price indicated on the website when you placed your order. We take all reasonable care to ensure that the price of the tour advised to you is correct.
    • If post-booking there is a change in price for or a tour, the change in price will not affect bookings which have already been placed.
    • Payment must be made in full at the time of booking and can only be made with a valid credit card or debit card.
  3. Your Obligations
    • You will arrive 15 minutes prior to the start time at the designated starting point as stated in the booking confirmation.
    • If you are running late for a tour, please call our customer services team on 0121 284 0909 who will direct you to join the tour group. This will only be available for the first 20 minutes of the tour. Should this happen, the cost of the tour will not be refunded.
    • Please bring confirmation of your booking to the tour.
    • Please dress appropriately and wear suitable footwear for the tour taking into account the weather.
    • You are obliged to comply with these terms at all times.
    • You must act reasonably and co-operate with us in the provision of the tours.
    • In the interests of health and safety, you must comply with all reasonable verbal instructions and requests from the Brum Tours representative.
    • Brum Tours reserve the right to refuse admission in a tour to anyone who is under the influence of drugs or alcohol. We also request that customers do not bring their own alcohol onto the tour. Anyone whose behaviour disrupts the tour or spoils the tour for any other customers will be asked to leave the tour. Should this happen, the cost of the tour will not be refunded.
  4. Your Rights To Make Changes
    Any requests to change an order for goods or a booking for a tour you have placed will be at the sole discretion of Brum Tours Limited.
  1. Our Rights To Make Changes
    Brum Tours may make the following changes to a tour:
  • The planned route of a tour may be varied if there are any road/pathway blockages restricting the usual planned route; and
  • Although every effort is made to ensure that tours are guided by the specified tour guide, we reserve the right to substitute in another guide of equal qualification.
  1. Our Liability To You
    • If we materially fail to comply with these terms, we are responsible for any material loss or damage you suffer that is a foreseeable result of our breach of the terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Material loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time the contract came into existence.
    • The total liability under clause 3.1 shall not exceed £2,000,000.
    • We do not exclude or limit in any way our liability for:
      • Death or personal injury caused by our negligence or the negligence of our employees;
      • Fraud or fraudulent misrepresentation;
      • Breach of the terms implied by the Supply of Goods and Services Act 1982;
      • Defective products under the Consumer Protection Act 1987.
  1. Cancellation
    • Your booking is only valid for the specific tour as detailed on your booking confirmation.
    • Your booking is non-transferable and non-refundable. 
  1. Goods
    • The images of the products on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device’s display of the colours accurately reflects the colour of the products. Your product may vary slightly from those images.
    • If we are unable to accept your order, we will inform you of this and will not charge you for the product.
    • Goods purchased through the online shop, are dispatched within 5 working days.
    • If our supply of goods is delayed by an event outside our control then we will contact you as soon as possible to let you know. We will not be liable for delays caused by the event..
    • Goods shall only be refunded if, within 28 days from the date of delivery, the goods are found to be faulty. All sales of gift vouchers are non refundable.

      9.1 Group & Exclusive Bookings 

      • We welcome Group & Exclusive bookings from a minimum of 25 to a maximum of 200 guests (venue depending).
      • On agreement with the date, you will be asked to pay a deposit with the balance to pay no later than 1 month prior to the event. Failure to complete the transaction at this time may lead to cancellation of your booking or increased costs due to the agreements with our suppliers.
      • Failure to reach the minimum number of 25 guests will result in payment of 25 guests regardless of the number of guests who attend the event.
      • Once payment has been made you will be sent an e-flyer that you can send to your delegates together with the VAT receipt and the information that you require for the event.
      • With no later than 1 month to the event, your group will need to supply meal selections. Failure to supply this in the timeframe mentioned may result in further charges mentioned in point 2 found above.
      • Group & Exclusive tours are required to act in an appropriate manner as any other tour and thus fall under the points made in point found above.
  2. How We May Use your Personal Information
    • We will use the personal information you provide to us:
      • to supply the tours and goods to you;
      • to process your payment for your purchases; and
      • if you agreed to this during the order process, to give you information about similar products that we provide, but you may stop receiving this at any time by contacting us.
    • We will only give your personal information to third parties where the law either requires or allows us to do so.
  3. Miscellaneous
    • The food provided during a tour may vary depending on the season and what is on the menu for each pub. Attendees will be given a choice of any soft drink, beer or wine to accompany their dinner.
    • Although accommodation is advertised on the website, Brum Tours Limited is not affiliated with any organisation providing such accommodation.
    • Children under the age of 16 must be accompanied by an adult over the age of 18.
    • A gift voucher is only valid from 6 months from the date of purchase. Tours must be booked prior to the expiry of the voucher.
    • Tour participants are responsible for their own personal safety at all times. We ask that you pay attention when crossing roads and that you do so with your own personal safety in mind. All children are under the responsibility of the accompanying adult.
  4. Other Important Terms
    • We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.
    • You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing.
    • This contract is between you and us. No other person shall have any rights to enforce any of its terms
    • Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
    • These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts.
    • Force Majeure. Brum Tours  shall not be liable for any failure of or delay in the performance of this agreement for the period that such failure or delay is
      * beyond their reasonable control,
      * materially affects the performance of any of its obligations under this agreement, and
      * Could not reasonably have been foreseen or provided against, but will not be excused for failure or delay resulting from only general economic conditions or other general market effects.
